Terms of Use

These Terms govern your use of the Blue Ocean Breeze SPC website and the commercial enquiries you send through it. They sit alongside the Privacy Policy and Compliance overview.

1. About us

This website is operated by Blue Ocean Breeze SPC, a company registered in the Sultanate of Oman with its operations centred on the Special Economic Zone at Duqm (SEZAD). For any queries about these Terms, write to [email protected].

2. Acceptable use

You agree to use the site in good faith and not to:

  • Submit false, misleading, or fraudulent information through contact or enquiry forms, or impersonate another person or organisation.
  • Attempt to probe, scan, or test the vulnerability of the website or its hosting infrastructure, bypass access controls, or interfere with the site's availability to other users.
  • Scrape, republish, or otherwise systematically copy content without our written permission, or use the site to train machine-learning models outside the scope of our licence.
  • Use the site to transmit unlawful material, malware, or unsolicited commercial communications.
  • Upload or submit content that infringes a third party's intellectual-property, privacy, or publicity rights, or that is defamatory, harassing, or otherwise unlawful.
  • Use the site in a manner that breaches applicable export controls, sanctions, or anti-corruption law.

We may suspend or block access (including by IP or network range) where use of the site appears to contravene these Terms, without prejudice to any other right or remedy.

3. Information on this site

We publish commercial and operational information in good faith and keep it current where practicable. Nothing on this site is a binding offer, a guarantee of service availability, a warranty of delivery timelines, or a substitute for the terms of an executed contract. Prices, specifications, and capabilities may change without notice. Where a written agreement with us conflicts with information on this site, the written agreement controls.

Operational content — including news posts, articles, and compliance notes — is written for general industry audiences. It does not constitute legal, tax, customs, or regulatory advice. Consult qualified counsel or licensed advisers in your jurisdiction before acting on anything you read here.

3a. Enquiries, quotations, and engagement

Submitting an enquiry through this site does not create a contract. It allows us to evaluate your requirements and, where feasible, return a written quotation or scoping note. A binding engagement arises only on our written acceptance of your order, or on the execution of a separate engagement document — whichever is applicable to the project.

By submitting an enquiry, you confirm that you have authority to do so on behalf of the organisation you represent, that the information you provide is accurate to the best of your knowledge, and that we may rely on it in preparing our response.

4. No financial services

Blue Ocean Breeze SPC is not a licensed financial institution and does not provide currency exchange, payment processing, investment, or settlement services. Any references on this site to settlement, invoicing, or banking describe commercial documentation support around cargo movements — not regulated financial activity.

5. Intellectual property

All trademarks, logos, text, imagery, page layouts, code, and other materials on this site ("Site Content") are owned by Blue Ocean Breeze SPC or licensed to us by their rightsholders. You may view and print Site Content for personal, non-commercial reference and for the ordinary course of evaluating our services. Any other use — including reproduction, redistribution, modification, framing, scraping, text-and-data mining, or use to train machine-learning models — requires our prior written consent.

Nothing on the site grants a licence to use the Blue Ocean Breeze SPC name, logo, or identifiers in a way that suggests endorsement, partnership, or authorised agent status unless expressly documented in writing between you and us.

5a. User-submitted content

Any material you submit through the site — including enquiry forms, attachments, technical specifications, drawings, or correspondence — remains your property. By submitting it you grant us a non-exclusive, royalty-free, worldwide licence to use, store, and reproduce the material for the limited purpose of evaluating and responding to your enquiry and, where relevant, performing an engagement that arises from it. You warrant that you have the rights necessary to grant this licence and that the submission does not infringe a third party's intellectual-property or privacy rights.

Do not submit information that is confidential to a third party unless you have authority to share it with us, and do not submit material subject to export-control classification without flagging it in the same message.

5b. Copyright complaints and takedown requests

If you believe content on our site infringes your copyright or other intellectual-property right, email [email protected]with the subject line "IP complaint" and include (i) identification of the protected material, (ii) the location of the allegedly infringing content on our site, (iii) your contact details, (iv) a statement of your good-faith belief that the use is not authorised, and (v) a statement, under penalty of perjury where applicable, that the information you provide is accurate. We will review and respond within a reasonable period.

6. Third-party links and services

The site may link to external resources operated by third parties, or display content served from third-party providers (for example, mapping services, document viewers, or hosted fonts). We do not control those resources and are not responsible for their content, privacy practices, security, or availability. Your use of third-party resources is governed by the terms and policies of the respective providers.

6a. Electronic communications and consent to contact

When you submit an enquiry through the site, you consent to be contacted by email at the address you provide for the purpose of responding to that enquiry and any follow-up reasonably related to it. You may opt out of non-transactional communications at any time by replying to an email we send you or by writing to us at [email protected].

7. Disclaimers and liability

The site is provided on an "as is" and "as available" basis. We make reasonable efforts to keep it online and free of malicious code, but we do not warrant that the site will be uninterrupted, error-free, or secure against every form of attack, nor that information on the site is complete or current.

To the fullest extent permitted by applicable law, we exclude liability for indirect, incidental, special, punitive, or consequential loss arising from use of this site, including loss of profits, opportunity, goodwill, or data. Where liability cannot lawfully be excluded, our aggregate liability is limited to the fees, if any, paid to us for the use of the site in the twelve months preceding the claim, or OMR 100 (whichever is greater), subject always to mandatory rules of law. Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be limited.

8. Indemnity

You agree to indemnify and hold harmless Blue Ocean Breeze SPC and its personnel against third-party claims, damages, and reasonable expenses (including legal fees) arising from your breach of these Terms, your misuse of the site, or any content you submit that is unlawful or infringes a third-party right. We will notify you of any such claim and allow you to participate in the defence, acting reasonably.

8a. Export controls and sanctions

You represent and warrant that your use of the site, and any engagement arising from it, complies with applicable export, sanctions, and anti-corruption laws — including, where they apply to you or your counterparties, regimes administered by the United Nations, the Sultanate of Oman, the United States (including OFAC), the European Union, and the United Kingdom. You will not use the site to facilitate transactions with persons or destinations that are subject to comprehensive sanctions, and you will flag potentially controlled items and destinations when you submit an enquiry.

9. Force majeure

Neither party will be liable for a failure or delay in performance (excluding payment obligations) caused by circumstances outside its reasonable control, including acts of God, war, civil unrest, terrorism, labour action, power or telecommunications failure, pandemic measures, or government action. The affected party will use reasonable efforts to mitigate the impact and will resume performance as soon as practicable.

10. Governing law and disputes

These Terms are governed by the laws of the Sultanate of Oman. The parties will attempt in good faith to resolve disputes arising from the site or these Terms through direct discussion before initiating proceedings. Unresolved disputes are subject to the non-exclusive jurisdiction of the competent Omani courts, without prejudice to mandatory consumer protections in your country of residence.

11. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force. Failure to enforce a provision is not a waiver of the right to enforce it later. You may not assign or transfer your rights or obligations under these Terms without our prior written consent; we may assign ours in connection with a reorganisation, merger, or sale of the relevant business. These Terms, together with the Privacy Policy and Compliance overview, constitute the entire agreement between you and Blue Ocean Breeze SPC regarding your use of this site, and supersede prior statements about the same subject matter (other than any written agreement signed between you and us, which prevails where it conflicts with these Terms).

12. Changes to these Terms

We may update these Terms to reflect changes in law, regulation, or our services. The current version is always posted on this page with the latest update date. Material changes may be highlighted at the top of the page for a reasonable period. Continued use of the site after a change constitutes acceptance of the updated Terms.

Legal notices related to the site or these Terms should be sent to [email protected] with a clear subject line, or by registered post to our registered office at Special Economic Zone at Duqm (SEZAD), Al Wusta Governorate, Sultanate of Oman. Notices are deemed received on the next business day for email and on the documented delivery date for post.
